Welcome to Erin Jacob Photography! I am committed to providing you with a safe and enjoyable photography workshop experience. Please carefully review the following terms and conditions before booking your workshop. By registering for a workshop, you agree to these terms.

General Information

  • Acceptance of Terms: Payment of the workshop fee confirms your acceptance of these terms and conditions.

Booking and Payment

  • Booking Process: Bookings are accepted on a first-come, first-served basis. To secure your spot, please complete the online registration form and pay the required deposit or full payment, depending on the terms of the workshop.

  • A non-refundable deposit is required to secure your booking. If the minimum number of participants is not reached, the deposit will be refunded in full. In all other cases, the deposit is non-refundable.

  • All amounts are in New Zealand Dollars.

  • Payment Method: Payments are to be made via bank transfer or credit card through my secure payment portal.

  • Full payment is due 90 days before the workshop start date. If payment is not received by this deadline, I reserve the right to cancel your booking, and any payments made may be subject to the cancellation policy outlined above.

Cancellation and Refund Policy

  • Cancellation by Participant: All cancellations must be made in writing via email to erin@erinjacobphotography.com

·       Upon receipt of your cancellation the following fees will apply:

180 days or more before commencement: 30% of the total fee is forfeited.
179 to 121 days before commencement: 50% of the total fee is forfeited.
120 to 91 days before commencement: 75% of the total fee is forfeited.
90 days or less before commencement: No refund will be issued.

  • Transfer to Another Person: If you are unable to attend, you may transfer your spot to another person. Please notify me in writing with the replacement participant’s details. The new participant must also agree to these terms.

  • No-Show Policy: No refunds will be issued for no-shows or participants who leave the workshop early.

Force Majeure

  • I am not liable for any cancellations, delays, or changes to the workshop due to events beyond my control, including but not limited to weather, natural disasters, pandemics, government restrictions, or any other unforeseeable event.

  • Postponement: In the event that the workshop is postponed due to force majeure, any payments made will be credited toward a future workshop.

  • Cancellation: If I am forced to cancel a workshop due to force majeure, you will be offered a full refund or the option to transfer to another workshop.

Insurance

  • Travel Insurance: it is strongly recommend that you obtain travel insurance to cover any cancellations, delays, medical emergencies, or loss or damage of personal items during the workshop.

  • Personal Injury & Health Insurance: It is your responsibility to ensure you have appropriate insurance for your health and safety.

  • Liability for Equipment: Erin Jacob Photography is not responsible for any damage, theft, or loss of personal equipment or belongings.

Itinerary Changes

  • Changes to Itinerary: I reserve the right to modify the itinerary if necessary, due to weather conditions, equipment failure, or any other reason beyond my control. Any significant changes will be communicated to you as soon as possible.

  • Photography Conditions: Landscape photography is dependent on numerous factors, including but not limited to weather and light conditions. I cannot guarantee specific photography opportunities.

Fitness, Health, and Behaviour

  • Fitness Level: My workshops are designed for participants that are in good health and moderate level of fitness. However, some workshops may involve walking, hiking, on uneven ground in wilderness or alpine areas.

  • Participants must carry their own gear, including camera equipment, extra clothing, food and water.

  • Health Disclosure: You must inform me of any health conditions or medical concerns that could affect your participation in the workshop. Failure to disclose such information may result in risks to your safety or ability to participate fully.

  • Limitation of Liability: Erin Jacob Photography is not liable for any injury, illness, or other consequences arising from your failure to disclose relevant health conditions.

  • Behaviour: Inappropriate behaviour, including harassment or disrupting the experience for others, will not be tolerated. I reserve the right to remove any participant from the workshop without a refund if their behaviour is deemed unacceptable.

Waiver of Liability

  • Assumption of Risk: By attending the workshop, you voluntarily assume all risks associated with outdoor photography and travel, including injury, illness, loss of property, or death.

  • By attending this workshop, you acknowledge and accept that Erin Jacob Photography, its owner (Erin Jacob), and any affiliated service providers are not liable for any personal injury, loss, damage, or expenses incurred during the workshop. You voluntarily assume all risks associated with outdoor photography and travel and release Erin Jacob Photography from any claims arising from your participation.

Promotions and Media Use

  • Media Consent: During the workshop, photographs and videos may be taken, including images of participants. By attending, you consent to the use of these images in promotional materials, including on my website and social media platforms. If you do not wish to be photographed, please inform me before the workshop.

  • Use of Testimonials: I may use testimonials provided by participants for promotional purposes. If you do not wish your testimonial to be used, please let me know in writing.

Privacy Policy

  • Personal Information: I collect and store personal information necessary to facilitate your booking, including your name, contact details, and payment information. I will only use your information for the purpose of running the workshop and maintaining my relationship with you.

  • Data Protection: I am committed to keeping your information secure. Your personal details will not be shared with third parties without your consent, except where required by law.

Miscellaneous

  • Amendments: Erin Jacob Photography reserves the right to amend these terms and conditions at any time. Any changes will be communicated to participants.

  • Governing Law: These terms and conditions are governed by the laws of New Zealand.
